Drug Charge Defense in Kissimmee and Osceola County
Florida treats drug cases more harshly than most states: possession of almost any controlled substance is a felony, and trafficking charges carry mandatory minimum prison sentences triggered by weight alone. Many of these cases also begin with a traffic stop or a search that deserves close scrutiny.
Possession, Sale, and Trafficking
• Drug Possession — simple and constructive possession, prescription pills, cannabis, paraphernalia, and possession with intent to sell
• Drug Trafficking — weight thresholds, mandatory minimums, and how trafficking cases are fought
• Pretrial Diversion — programs that can resolve qualifying cases without a conviction
The License Consequence Most People Don't Expect
Under § 322.055, Florida Statutes, an adult convicted of possessing, selling, or trafficking a controlled substance faces a driver’s license suspension of 6 months — or until the person is evaluated and, if required, completes an approved treatment program. In some cases the court can allow a business-or-employment-only license. How a case is resolved can determine whether this applies at all.
How Drug Cases Are Defended
• The search. Was the stop lawful? Was there consent, a warrant, or a valid exception?
• Possession. Drugs found in a shared car or home don't automatically belong to everyone nearby — the State must prove knowledge and control.
• The lab and the weight. Testing, mixtures, and packaging can move a case below a threshold.
• Alternatives. Diversion and treatment-based resolutions are often available, especially for first offenses.
